New York Employers: Workers Comp Forms Everyone Should Know

This article will look at some of the common workers comp forms for New York.

Most Common Workers Comp Forms for New York 

Employer Forms 

C-3 Form: This form is used by the employer to report to their workers' compensation insurance carrier when an employee has been hurt or become ill while performing their job duties. It should be submitted within 10 days of being notified of the incident/sickness. 

C-8 Form: This form is used by the employer to challenge a workers' compensation claim. The C-8 form is to be submitted to the New York State Workers' Compensation Board within 18 days of receiving notice regarding the claim. 

C-240 Form: This form is used by the employer to request an independent medical examination (IME) for the injured worker. The C-240 form is to be submitted to the New York State Workers' Compensation Board and the injured worker's attorney, if applicable. 

Employee Forms

C-2 Form: This form is used by injured or sick workers to report a workplace illness or injury to their employer. It should be completed within 30 days of the accident/hazard or 24 months if it is a repetitive stress injury. 

C-7 Form: This form is used by the injured or ill worker to request a hearing with the State Workers' Compensation Board in New York. The C-7 form should be submitted to the Board within 24 months of the incident/sickness. 

Doctor's Forms 

Although only medical professionals deal with these, being familiar with all of the worker's comp forms for New York helps both employers and workers understand more about their cases and what is needed to complete the process. 

C-4 Form: This form is used by the doctor to report an injured worker's medical condition to the employer's worker’s compensation insurance company. The doctor should complete the form within 48 hours of the initial treatment and send it to the insurance carrier. 

C-4.2 Form: This form is used by the doctor to report an injured worker's progress and status to the employer's worker’s compensation insurance provider. It should be submitted every 45 days if the injured worker is not working, and every 90 days if the injured worker is working with restrictions. 

C-4.3 Form: This form is used by the doctor to report an injured worker's permanent impairment rating to the employer's workers' compensation insurance carrier. The doctor should complete the form once the injured worker has reached maximum medical improvement.

C-4.3 (S) Form: This form is used by the doctor to inform the New York State Workers' Compensation Board of the injured worker's permanent impairment rating. Just as with C-4.3 Form. It should be completed once the injured worker has reached their maximum improvement potential.

How to Avoid Getting Overwhelmed
